Eligibility

You must be at least 13 years old to use ROMetrics. By using the service, you represent that you meet this requirement.

Account Registration & Authentication

Some features may require account creation using email/password or third-party authentication providers (such as Google Sign-In).

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Acceptable Use

You agree not to:

• Use the service for unlawful or unauthorized purposes
• Attempt to gain unauthorized access to systems or data
• Interfere with or disrupt service functionality
• Reverse engineer or misuse the platform

Educational & Informational Use Disclaimer

ROMetrics provides educational, analytical, and informational tools. The platform does not provide medical diagnosis, treatment, or professional healthcare advice.

Any decisions made based on information from ROMetrics are your sole responsibility.

Intellectual Property

All content, software, designs, trademarks, and materials provided through ROMetrics are owned by or licensed to Kington Digital Systems LLC.

You may not copy, modify, distribute, or exploit any portion of the service without prior written permission.

Service Availability

We strive to keep the service available, but do not guarantee uninterrupted or error-free operation. Features may change or be discontinued at any time.

Beta Program Disclaimer

ROMetrics may offer certain features or versions of the service in beta, preview, or pre-release form ("Beta Services").

Beta Services are provided for testing and evaluation purposes only and may contain bugs, errors, security issues, or incomplete functionality.

We do not guarantee the reliability, availability, or performance of Beta Services. Features may be modified, suspended, or removed at any time without notice.

You acknowledge that data entered into Beta Services may be lost, corrupted, or reset, and you agree to use Beta Services at your own risk.

Feedback submitted during the beta period may be used to improve future versions of ROMetrics.

Termination

We may suspend or terminate access to the service at our discretion if these Terms are violated or if continued use poses risk to the platform or users.

Limitation of Liability

To the maximum extent permitted by law, Kington Digital Systems LLC shall not be liable for any indirect, incidental, or consequential damages arising from use of the service.

Payments, Subscriptions & Refunds

Certain features of ROMetrics may require payment, including subscriptions or one-time purchases.

All fees are disclosed at the time of purchase and are non-refundable except as required by law or as otherwise stated in this section.

If purchases are made through third-party platforms (such as Google Play), refunds and billing disputes are subject to the policies of those platforms.

We do not control and are not responsible for refunds processed by third-party payment providers.

For purchases made directly through ROMetrics, refund requests must be submitted to support@rometrics.app within fourteen (14) days of purchase and will be reviewed on a case-by-case basis.

We reserve the right to deny refund requests in cases of misuse, abuse, or violation of these Terms.

Cancellation: You may cancel your ROMetrics subscription at any time. If you subscribed through a third-party platform (such as Google Play), you must cancel through that platform's subscription settings.

Upon cancellation, you will continue to have access to paid features until the end of your current billing period. No further charges will be applied after the current period expires.

Promotions & Referral Codes

ROMetrics may occasionally offer promotional codes, referral rewards, or other incentives ("Codes"). Unless explicitly stated otherwise, each Code is valid for one-time use only and cannot be combined with other offers.

Codes have no cash value, are non-transferable, and may not be sold or exchanged. We reserve the right to void or cancel Codes at our discretion if we suspect fraudulent activity, self-referral, or misuse of the referral system.

Redemption of a "1 Month Free" code applies only to the initial or next billing cycle. Standard subscription rates will apply automatically after the promotional period ends unless the subscription is cancelled.

Payment Processing & Third-Party Providers

ROMetrics uses third-party payment processors, including Stripe, to process subscriptions and other payments. Certain purchases may also be subject to Google Play’s billing policies.

By making a purchase, you authorize us and our payment partners to charge your selected payment method for applicable fees, taxes, and renewals.

Payment methods, processing times, fees, and security practices may vary depending on the provider and the payment method selected.

Third-party payment providers operate under their own terms of service and privacy policies. We encourage you to review the applicable policies before completing a transaction.

ROMetrics does not control and is not responsible for the acts, omissions, outages, or policies of third-party payment processors.

In the event of billing errors, payment failures, or disputes, you agree to first contact the relevant payment provider or our support team for resolution.

Privacy

Your use of ROMetrics is also governed by our Privacy Policy.

Dispute Resolution, Arbitration, and Class Action Waiver

Please read this section carefully. It affects your legal rights.

You and Kington Digital Systems LLC (DBA "ROMetrics") agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of ROMetrics shall be resolved through final and binding arbitration, rather than in court, except that either party may bring an individual action in small claims court if eligible.

Arbitration shall be administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, which are available at www.adr.org.

The arbitration shall be conducted on an individual basis only. Neither you nor we shall be entitled to participate in a class action, class arbitration, or other representative proceeding.

You agree that you waive any right to bring or participate in any class, consolidated, or representative action against ROMetrics.

The arbitrator shall have the authority to grant any relief that would otherwise be available in court under applicable law.

Each party shall bear its own attorneys’ fees and costs, except as otherwise required by law or determined by the arbitrator.

Nothing in this section shall prevent either party from seeking injunctive or equitable relief in a court of competent jurisdiction for the protection of intellectual property or other legal rights.

You may opt out of this arbitration and class action waiver within thirty (30) days of first accepting these Terms by sending written notice to admin@rometrics.app, including your name and account email address.

Governing Law & Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law principles.

Any legal action or proceeding permitted under these Terms shall be brought exclusively in the state or federal courts located within the State of Ohio, unless otherwise required by applicable law.

Changes to These Terms

We may update these Terms from time to time. Continued use of the service after changes are posted constitutes acceptance of the revised Terms.
